By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
UniversalCommonsWay offers luxury yacht charter services inclusive of:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
All services are subject to availability and weather conditions. We reserve the right to modify or discontinue services at any time without prior notice.
3. Booking and Reservations
3.1 Booking Process
For reservation of a charter, the following conditions must be met:
- Be at least 18 years of age
- Supply accurate and complete details
- Remit the necessary deposit as outlined in the booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A booking is regarded as confirmed only after payment is received and we provide written acknowledgment. We retain the right to decline service to anyone at our discretion.
3.3 Availability
Charter availability hinges on the accessibility of vessels and favorable weather conditions. We will endeavor to accommodate your preferred timing and dates whenever possible.
4. Payment Terms
4.1 Pricing
Quoted prices are in € and cover any relevant taxes unless stated otherwise. Prices can change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the total cost for the charter is due at the time of booking
- Balance: Payable 48 hours before the departure of the charter
- Additional fees (should they arise): Payable upon conclusion of the charter
4.3 Payment Methods
Accepted methods of payment include major credit cards, bank wires, and certified checks. We employ secure and encrypted methods for processing payments.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Refund issued minus any processing charges
- 24-72 hours before departure: 50% of the booking amount is refundable
- Less than 24 hours before departure: No refund provided
5.2 Weather Cancellations
If the captain determines the weather to be unsafe, we will propose either:
- Rescheduling the charter to the next possible date at no extra charge
- Issuing a full refund if rescheduling is not viable
5.3 Mechanical Issues
In case of mechanical issues with the designated yacht, our attempt will be to arrange an alternate vessel. Should no substitute be available, a full refund will be granted.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Comply with the crew's instructions
- Use provided safety gear as necessary
- Inform us of any medical conditions that may impact their safety
- Stay within the vessel's designated passenger areas
6.2 Prohibited Items
It is prohibited to bring aboard:
- Containers made of glass
- Illicit substances
- Guns or any form of weapons
- Pets (save for those pre-authorized)
6.3 Conduct
Passengers should carry themselves respectfully. Any behavior that poses a risk to safety or disturbs other passengers may lead to the early termination of a charter without a return of payment.
7. Liability and Insurance
7.1 Our Liability
Our liability is confined to the fee paid for your charter, and we are not responsible for:
- Personal injuries due to passenger negligence
- The loss or destruction of personal belongings
- Indirect losses, consequential damages, or punitive damages
- Delays resulting from weather or factors beyond our control
7.2 Insurance Coverage
We carry comprehensive insurance for our vessels and operations. Passengers should secure their individual travel and property insurance.
7.3 Assumption of Risk
By partaking in our charter services, you admit to the inherent risks involved in maritime activities and you take responsibility for your safety and health.
8. Modifications and Itinerary Changes
We keep the right to alter itineraries, courses, or timetables due to weather, safety, or operational demands. Our aim will be to provide alternative experiences of equivalent quality.
9. Force Majeure
We are not accountable for any suspension, cancellation, or change of service brought about by events beyond our control, which can include:
- Severe weather phenomena
- Natural calamities
- Governmental directives
- Port shutdowns
- Vessel malfunctions
10. Privacy and Data Protection
Your personal data is managed in line with our Privacy Policy. When you utilize our services, you consent to your data being collected and used as specified in our Privacy Policy.
11. Intellectual Property
Our website's content, including texts, graphics, logos, and images, is safeguarded by laws relating to copyright and trademarks. Reproduction, dissemination, or the creation of derivative works without our express written consent is not permitted.
12. Governing Law
Applicable laws of Germany govern these Terms, and any issues will be resolved in the courts located in Hamburg, Germany.
13. Changes to Terms
